El artículo quiere reflexionar sobre la conflictiva relación que desde la antigüedad la sociedad occidental tuvo con el fuego, y profundizar en la disciplina histórica del incendio doloso en el ámbito hispano. Esto permitirá reunir un conjunto de elementos sociales y jurídicos que permitan demostrar que dicha normativa no tenía solo la finalidad de castigar a los responsables de este delito, sino que estaba pensada para estigmatizarlos socialmente; y que la sociedad decimonónica encontró en la incipiente literatura popular y en su expresión más comercial, las novelas de entrega o folletines, una nueva herramienta útil para conseguir este objetivo primario, pues la estigmatización social de estos criminales operaba como elemento disuasorio.
The article wants to reflect on the conflicting relationship that Western society has had to fire since ancient times and deepen into the historical discipline of arson in the Hispanic context. This will allow to collect a set of social and legalelements that will be able to demonstrating how that legislation was not only intended to punish the arsonists, but was designed to stigmatize them socially;and thenineteenth-century society found in the incipient popular literature, and in its most commercial expression, the novelas de entregaorfolletines, a new useful tool to achieve this primary objective, becausethe social stigmatization of these criminals workedas a deterrent.
