El propósito de estas notas es desarrollar la configuración constitucional de la autonomía universitaria en la Constitución Costarricense de 1949, en concreto, en su artículo 84 y desde una perspectiva analítica y comparada, se buscará señalar si corresponde dicha configuración con un derecho fundamental, inherente a todo ser humano en cuanto es titular de dignidad, o bien, si se ha realizado como una garantía institucional, a favor de la Universidad de Costa Rica y demás universidades estatales, a quienes, justamente, el Poder Constituyente originario les ha atribuido, como lo veremos infra, el más alto grado de autonomía con respecto a la Administración Central.
The purpose of these notes is to develop the constitutional configuration of university autonomy in the Costa Rican Constitution of 1949, specifically, in its article 84 and from an analytical and comparative perspective, it will be sought to indicate if such configuration corresponds with a fundamental right inherent in every human being insofar as he is the holder of dignity, or, if it has been carried out as an institutional guarantee, in favor of the University of Costa Rica and other state universities, to which, precisely, the original Constituent Power has attributed them, as we will see below, the highest degree of autonomy with respect to the Central Administration.
