Frente a las críticas acerca de la negación del sujeto en la Filosofía del Derecho (FD), se trata de ver el papel decisivo que juega el individuo en la moral; sin la subjetividad del individuo no puede haber moral propiamente dicha; esta es la importancia moral del individuo (1). El surgimiento del individuo ha tenido un amplio desarrollo histórico (2): el individualismo romano (2.1), la aportación del cristianismo (2.2) y el individualismo moderno (2.3).
Finalmente el escrito se centra en el lugar que ocupa el individuo en la FD (3). La persona individual como primera figura jurídica (3.1), el derecho de la voluntad subjetiva (3.2) y finalmente la relación de la conciencia moral con el orden legal (3.3), que es el lugar donde fundamentalmente se decide el valor del individuo frente a la legalidad y el Estado
Against the critics about the negation of the subject in Hegel’s Philosophy of Right, our aim is to look upon the decisive role played by the individual in Moral, for without the individual’s subjectivity there cannot be Moral in strict sense; this is the moral importance of the individual (1). The emergence of the individual has had a wide development in history (2): Roman individualism, (2.1), the contribution of Chistianism (2.2) and modern individualism (2.3). Finally, this study focuses on the place of the individual in Philosophy of Right (3). The individual person as first lawful figure (3.1), the right of subjective will (3.2) and the relation of moral consciousness to legal order (3.3), which is the domain where the value of the individual is basically decided against law and the State.
