En el debate que mantiene en sus primeros escritos con las teorías del derecho natural y la moral de su época, Hegel opera con dos nociones diferentes de “positividad”. En un primer sentido, lo “positivo” designa el resultado de un método formal deficiente que aísla artificialmente un componente de la totalidad y lo considera por sí solo, independizándolo de su pertenencia al conjunto o incluso absolutizándolo como si fuese la clave para la comprensión de la realidad. En un segundo sentido, lo “positivo” designa la concepción unificadora de la eticidad, en la medida en que esta es interpretada, siguiendo la inspiración de Aristóteles y Spinoza, como la naturaleza esencial y el ethos realizado de un pueblo. Estas dos definiciones de positividad no son contradictorias, sino que se complementan recíprocamente. A través de esta llamativa y fructífera ambivalencia se esclarece el sentido de la relación entre costumbre ética y ley, entre Sitte y Gesetz, y se ponen de manifiesto las razones que inducen a Hegel a proponer, con conciencia histórica, una concepción sistemática de la eticidad.
In the debate that he maintains in his early writings with the theories of natural law and morality of his time, Hegel operates with two different notions of “positivity”. In a first sense, the “positive” designates the result of a deficient formal method that artificially isolates a component of the totality and considers it by itself, making it independent of its belonging to the whole or even making it absolute as if it were the key to understanding the reality.
In a second sense, the “positive” designates the unifying conception of ethics, insofar as it is interpreted, following the inspiration of Aristotle and Spinoza, as the essential nature and realized ethos of a people. These two definitions of positivity are not contradictory but complement each other. Through this striking and fruitful ambivalence, the meaning of the relationship between ethical custom and law, between Sitte and Gesetz, is clarified, and the reasons that lead Hegel to propose, with historical awareness, a systematic conception of ethical live are revealed.
