Los presuntos infractores que aparecen en grabaciones de video que se ubican en las redes sociales tienen derecho a la prueba contradictoria de los hechos. No basta, por tanto, con la ratificación de los agentes que simplemente visionaron el video. Debe procederse a admitir y valorar la prueba de contrario antes de imponer, en su caso, la sanción.
Alleged infringers who appear in video recordings uploaded on to social networks have the right to submit evidence opposing the facts. In this regard, the ratification of agents who simply viewed the video is not in itself sufficient. Evidence refuting the facts must be admitted and assessed before the penalty is imposed, if appropriate.
