El presente trabajo tiene como finalidad analizar el proceso evolutivo que ha tenido el derecho penal en el mundo e identificar los lastres históricos inconsistentes que siguen vigentes en la actualidad y que el derecho penal no ha podido superar. Los estudios vertidos en este trabajo hacen especial referencia a la estructura jurídica mexicana, ya que el actual estado del arte, muestra que aún se siguen aplicando figuras jurídicas contradictorias e incluso violatorias de derechos humanos, lo que hace cuestionarnos si el sistema penal mexicano verdaderamente ha evolucionado hacia un genuino sistema garantista
The purpose of this work is to analyze the evolutionary process that criminal law has had in the world, and to study the last inconsistent histories that are still in force today and that criminal law has not been able to overcome. The studies published in this work make special reference to the Mexican legal structure, since the current state of the art shows that contradictory and even human rights violations continue to be applied, which makes us question whether the Mexican criminal system has truly evolved towards a genuine guarantee system
