El pasado mes de marzo la Audiencia Nacional presentó cuestión prejudicial ante el Tribunal de Justicia de la Unión Europea en orden a resolver la solicitud de entrega a las autoridades de Portugal de una de las personas implicadas en la trama portuguesa del caso Forum Filatélico. Se plantea en el caso la extensión y alcance del principio ne bis in idem cuando los hechos, aun presentando una manifiesta autonomía, se encuentran dentro del mismo plan preconcebido que es propio de la continuidad delictiva.
Last March, the Spanish High Nation Court submitted a question to the Court of Justice of the European Union for a preliminary ruling in order to solve the request for surrender to the Portuguese authorities of one of the persons involved in the Portuguese plot in the Forum Filatélico case. The case raises the question of the extent and scope of the ne bis in idem principle when the acts, although clearly autonomous, are part of the same preconceived plan that is characteristic of criminal continuity.
