From the second decade of the twenty-first century onwards, the official, generalized and global recognition of the climate and environmental emergency that unfolds from the ecological crisis, requires the adoption of the principle of innovation as a rule. Innovation can happen at the scientific, technological, social and economic level, but also and above all, innovation can happen at the legal level. As a matter of fact, law must play a role of lever of the other innovations and no longer be an obstacle to innovations that are fundamental for the transition to more sustainable development models.
À partir de la deuxième décade du XXIe siècle, la reconnaissance officielle, généralisée et globale de l’urgence climatique et environnementale qui découle de la crise écologique, impose l’adoption du principe de l’innovation comme règle. Il s’agit de l’innovation scientifique, technologique, sociale, économique, mais aussi et avant tout, de l’innovation juridique. En effet, le droit joue un rôle de levier des autres innovations et non plus d’obstacle à l’innovation fondamentale pour la transition vers des modèles de développement plus durable.
