El objetivo de este estudio es poner de relieve la importancia del lenguaje claro en el ámbito jurídico. Para ello, se hará un recorrido de la simplificación de esta lengua de especialidad en países relevantes como ee. uu., Reino Unido, Suecia, algunos latinoamericanos y, por último, España.
A continuación, mediante un análisis contrastivo de las estrategias más frecuentes en la redacción jurídica en las sentencias españolas y en las de lengua inglesa, se presentarán los principales obstáculos a la hora de comprender las resoluciones judiciales en la actualidad. A partir de rasgos muy frecuentes al redactar sentencias, se darán ejemplos de fragmentos de sentencias reales que pueden suponer un obstáculo a la hora de comprender el texto. A su vez, se propondrá una simplificación de dichos fragmentos como posible ilustración de vías concretas para contribuir a la modernización del español jurídico. Por último, se analizarán las razones de su demora en España en comparación con otros países y se arrojará luz sobre la relevancia de simplificar este tecnolecto en concreto.
The aim of this study is to highlight the importance of plain language in the legal field. To this end, i will make an overview of the simplification of this specialised language in relevant countries such as the usa, the United Kingdom, Sweden, some Latin American countries and, finally, Spain. Then, by means of a contrastive analysis of the most frequent strategies used in legal writing in both English and Spanish decrees, i will present the main obstacles to understand these orders today. Based on common features used when writing judgements, i will give examples of fragments of real decrees that may be an obstacle to understanding the text. In turn, i will propose a simplification of these fragments as an exemplification of the possible means which may contribute to the modernisation of the legal language. Finally, i will analyse the reasons for its delay in Spain when compared to other countries and i will shed light on the relevance of simplifying this particular technolect.
