El trabajo analiza la Justicia restaurativa como un servicio para la víctima y una oportunidad de resocialización para el victimario desde las posibilidades restaurativas que ofrece el cumplimiento de la pena de prisión por su relación con el tratamiento penitenciario. Para ello se exponen las características de los programas restaurativos después de la condena y los instrumentos de la legislación penitenciaria que facilitan los acuerdos reparadores con la víctima y humanizan la pena de prisión.
This paper analyzes the Restorative Justice as a service for the victim and a opportunity for the resocialitation of the ofender from the restorative possibilities during the execution of theimprisonment and its relationship with prison treatment. To get it, the characteristics of restorative programs after the sentence and the legal penitentiary instruments which facilitate the reparatory agreements with the victim and which humanize the imprisonment are exposed.
