The integration of Romania into the European Union, carried out on January 1, 2007, has resulted in an extensive process of reaccommodation of the national legislation. The direct and immediate application of European law rules in domestic, national law, the transposition of directives into national law and the modernization of legislation have meant as many challenges for the national legislature as they have for the national judicial system. The study presented the way in which Romania has positioned itself in relation to Union law and to the principles that govern its existence. The elements of European law and the doctrinal discussions about the nature and implications of this mechanism in strengthening the rule of law were examined in this paper.
L’intégration de la Roumanie dans l’Union européenne, le 1er janvier 2007, a eu pour effet un vaste processus de réadaptation de la législation nationale. L’application directe et immédiate des règles du droit européen dans le droit interne, national, la transposition des directives dans le droit national et la modernisation de la législation ont signifié autant de défis pour le législateur national que pour le système judiciaire national. L’étude a présenté la manière dont la Roumanie s’est positionnée par rapport au droit de l’Union et aux principes qui régissent son existence. Les éléments du droit européen et les discussions doctrinales sur la nature et les implications de ce mécanisme dans le renforcement de l’Etat de droit ont été examinés dans cette étude.
