En Colombia, se han producido avances significativos en garantías y derechos para grupos de especial protección como los niños en situación de diversidad funcional, entre las diferentes medidas jurídicas, se encuentra; la pensión especial anticipada, instaurada para que padres con hijos en situación de diversidad funcional puedan retirarse oportunamente del trabajo y dedicarse al cuidado de sus hijos. En tal sentido, desde la revisión bibliográfica-documental con análisis crítico, se analiza la protección que brinda esta pensión especial frente al principio del interés superior del niño como derecho humano. Concluyéndose, que su aplicación se encuentra en tensión con la capacidad de respuesta operativa-financiera del Estado.
In Colombia, there have been significant advances in guarantees and rights for special protection groups such as children in situations of functional diversity, among the different legal measures, are found; the special anticipated pension, established so that parents with children in situations of functional diversity can withdraw from work and take care of their children. In this sense, from the bibliographic-documentary review with critical analysis, the protection offered by this special pension is analyzed against the principle of the best interests of the child as a human right. Concluding, that its application is in tension with the operational-financial response capacity of the State.
