Este artículo explora las interacciones del derecho humano a la libertad de expresión frente a los trols, bots y fake news. El autor parte por caracterizar la libertad de expresión y delimitar sus alcances genéricos, para luego revisar en qué medida podría proteger estas nuevas manifestaciones derivadas del auge de las tecnologías de la información y comunicación y, en particular, de las redes sociales. Finalmente, se abordan algunas medidas propositivas para dar tratamiento a los aspectos problemáticos derivados de la masificación de los trols, bots y fake news, pues, para el autor, la posibilidad de instaurar una regulación desde el Estado debería ser descartada.
This article explores the interactions between freedom of expression and trolls, bots and fake news. The author starts by characterizing freedom of expression and delimiting its generic scope and then reviewing to what extent it could protect these new manifestations derived from the rise of information and communication technologies and, in particular, social media. Finally, some measures are addressed to deal with the problematic aspects derived from the massification of trolls, bots and fake news, since, according to the author, the possibility of establishing a regulation from the State should be ruled out.
