La aprobación de la Orden Europea de Investigación supone una modificación del automatismo establecido respecto de las resoluciones judiciales por el principio del reconocimiento mutuo. La piedra angular del sistema se traslada a los derechos fundamentales siendo necesario analizar los problemas que se plantean cuando el órgano emisor de la OEI es el Ministerio Fiscal y se establece la necesidad del cambio de doctrina de los Tribunales españoles de la no indagación al control del respeto de los derechos fundamentales.
The approval of the European Investigation Order implies a modification of the automaticity established with respect to judicial decisions by the principle of mutual recognition. The cornerstone of the system is transferred to fundamental rights, and it is necessary to analyze the problems that arise when the issuing body of the EIO is the Public Prosecutor’s Office and the need to change the doctrine of the Spanish Courts of the non-inquiry into the control of the respect for fundamental rights.
