The research discusses the criminal selectivity of the Brazilian criminal system, resulting from the structural racism present in the roots of the country's institutions. The research introduces the perspective of memory as an epistemological category in the study of history and penal sciences, seeking to point out its importance to know and treat, with truly solutions, social problems such as the racism that finds its maximum expression in the racial genocide that takes place within the walls of the Brazilian prison. Through a qualitative approach, of an inductive nature, and by means of a literature review, we want to demonstrate that the social phenomenon of the massive incarceration that occurs in Brazil is indeed a form of genocide, which especially affects the young, black and poor people of the periphery, such result being part of a project of the power structures of the State to persecute and segregate social groups.
A pesquisa discorre sobre a seletividade penal do sistema criminal brasileiro, decorrente do racismo estrutural presente nas raízes das instituições do país. A investigação introduz a perspectiva da memória como categoria epistemológica no estudo da história e das ciências penais, buscando apontar sua importância para conhecer e tratar, com soluções verdadeiramente satisfatórias, a problemas sociais como o racismo estrutural que encontra sua expressão máxima no genocídio racial que tem lugar dentro das muralhas do cárcere brasileiro. Assim, através da abordagem qualitativa, de natureza indutiva e por meio de revisão de literatura, se quer demonstrar que o fenômeno social do encarceramento massivo que ocorre no Brasil é, sim, uma forma de genocídio, que atinge especialmente aos jovens, negros e pobres da periferia, sendo tal resultado parte de um projeto das estruturas de poder do Estado para perseguir e segregar a determinados grupos sociais.
