The aim of the article is to compare the treatment of authorship mediated by domain by organization in Brazilian dogmatics and jurisprudence with its international equivalents. Therefore, in a first moment it is described how the theory was received in Brazil by the doctrine and the jurisprudence of the STF and TRF4, punctuating dogmatic contradictions, mistakes, and omissions. In a second step, the Argentine, German, Spanish, Peruvian and Greek practice is described, observing and highlighting the fundamentals used by each court to accept or reject Roxin’s theory. The purpose is to verify how the experience of other countries can help the application of the theory in national jurisprudence.
O objetivo do artigo é comparar o tratamento da autoria mediata pelo domínio por organização na dogmática e jurisprudência brasileira com suas equivalentes internacionais. Para tanto, em um primeiro momento, descreve-se como a teoria foi recepcionada no Brasil pela doutrina e pela jurisprudência do STF e TRF4, pontuando as contradições, equívocos e omissões dogmáticas. Já em um segundo momento, descreve-se a prática argentina, alemã, espanhola, peruana e grega, observando e destacando os fundamentos empregados em cada tribunal para acolher ou rechaçar a teoria de Roxin. A finalidade é verificar como a experiência de outros países pode ajudar na aplicação da teoria na jurisprudência nacional.
