The pandemic reveals the insufficiency of the mechanisms for supplying informed consent to those who are subject to invasive ventilation and sedation, when there is the possibility of participating in trials, and highlights the scarcity of vaccines necessary for group immunity; the breach of patents is inefficient to overcome this shortage, due to insufficient information disclosed, not accompanied by the transmission of know- how. such insufficiency reveals the inadequacy and needlessness of the patent system to protect information from R&d of biological vaccines and medicines and to guarantee the return on investment, and questions the current duration of protection afforded by the patent, in a global emergency and vaccine shortage. this may constitute abuse of the right, to the detriment of public health, and excessive income capture. the delay in vaccine supplies may make the presence of the virus and the disease recurrent, with all the resulting social costs.
