A presente pesquisa tem como objetivo o estudo sobre o reconhecimento do outro enquanto sujeito de direitos no Estado-nação, acerca do fenômeno migratório frente ao cenário biopolítico. Devido ao fato de a mobilidade humana transcender as fronteiras, o espaço de ação do migrante questiona os limites e funções do Estado, tanto no que concerne sua recepção ao corpo social, quanto aos requisitos para enquadrar-se enquanto detentor do direito a ter direitos. O espaço do migrante não é o espaço Estatal, mas nele produz diferentes formas de interação e demanda ampliação, redefinindo suas estruturas, o que pressupõe a compreensão da complexidade de relações que o fluxo migratório carrega. Assim, pretende-se analisar a compreensão do migrante enquanto sujeito de direitos perante o cenário biopolítico, e a concretização da universalidade dos Direitos Humanos, frente ao Estado nacionalista.
The present research has as objective the study on the recognition of the other as subject of rights in the nation-State, about the migratory phenomenon front the biopolitical scenario. Due to the fact that human mobility transcends borders, the migrant's space of action questions the limits and functions of the State, both in terms of its reception to the social body, and the requirements to qualify as a detainer of the right to have rights. The space of the migrant is not the State space, but it produces different forms of interaction and demands expansion, redefining its structures, which presupposes the understanding of the complexity of relations that the migratory flow carries. Thus, we intend to analyze the understanding of the migrant as a subject of rights before the biopolitics scenario, and the realization of the universality of Human Rights, front of the nationalist State
