El presente trabajo tiene por objeto exponer algunos límites a la potestad reglamentaria de la Administración y determinar si estos son aplicados en el Ecuador. Para ello, he expuesto brevemente qué es el reglamento y la naturaleza de la potestad reglamentaria. Posteriormente, he analizado, mediante ejemplos, la vulneración dentro del ordenamiento jurídico ecuatoriano a varios límites de esta potestad como la competencia, jerarquía normativa y reserva de ley. De esta forma, planteo que estas vulneraciones pueden ser, a veces irrelevantes, y otras veces trascendentales para provocar la conculcación de principios generales del Derecho Administrativo.
This paper aims to expose the limits of the regulatory authority of the Administration and determine if these are applied in Ecuador. To do this, I briefly outlined what regulation is and the nature of regulatory power. Subsequently, I have analyzed, by means of examples, the violation within the Ecuadorian legal system to several limits of this power as the jurisdiction, normative hierarchy and reservation of law. In this way, I argue that these infringements can be sometimes irrelevant, and sometimes transcendental to provoke the violation of general principles of Administrative Law.
