En el Perú el transcurso del tiempo ha supuesto, en la práctica, reconocer que la mera adopción de tecnologías digitales junto con dispersa regulación han resultado insuficientes tanto para organizar de modo eficiente un Gobierno Digital como para impulsar una administración pública eficiente y eficaz en prestación de trámites y servicios públicos a través de medios digitales, y que, junto con un infraestructura de comunicaciones que no ha completado el despliegue de Internet en todo el territorio, así como las necesarias mejoras de capacidades de servidores y funcionarios, se precisan que se operen cambios estructurales junto con un arreglo normativo que establezca y determine, al tiempo, una adecuada gobernanza del referido proceso de adopción de tecnologías digitales y que oriente de forma ordenada como progresiva el tránsito al entorno digital, todo ello sin descuidar las garantías como los derechos fundamentales de los ciudadanos y personas en general en dicho entorno. El presente trabajo expone las acciones que encaminaron la aprobación del Decreto Legislativo No. 1412, Decreto Legislativo que aprueba la Ley de Gobierno Digital, y su Reglamento, aprobado mediante el Decreto Supremo No. 029-2021-PCM.
In Peru, the passage of time has meant, in practice, to recognize that the mere adoption of digital technologies together with scattered regulation have been insufficient both to efficiently organize a Digital Government and to promote an efficient and effective public administration in the provision of services. procedures and public services through digital means, and that, together with a communications infrastructure that has not completed the deployment of the Internet throughout the territory, as well as the necessary improvements in the capacities of servers and officials, changes are required together with a regulatory arrangement that establishes and determines, at the same time, an adequate governance of the aforementioned process of adoption of digital technologies and that guides the transition to the digital environment in an orderly and progressive manner, all without neglecting guarantees such as the fundamental rights of citizens and people in general in that environment. This work presents the actions that led to the approval of Legislative Decree No. 1412, Legislative Decree that approves the Digital Government Law, and its Regulations, approved by Supreme Decree No. 029-2021-PCM
