Este trabajo aborda un análisis jurídico formal y material sobre los requisitos de legalidad delos nueve indultos concedidos por el Gobierno. Deslinda los aspectos propios del control parlamentario y de la responsabilidad política a los que está sometido el Gobierno al conceder losindultos de aquellos susceptibles del control judicial frente a los eventuales recursos. El textoanaliza pormenorizadamente el informe desfavorable a la concesión de los indultos de la SalaSegunda del Tribunal Supremo y de la Fiscalía del Supremo y concluye que los indultos cumplencon los requisitos de legalidad.
This work addresses a formal and material legal analysis about the requirements of legality tothe nine pardons granted by the Government. It delineates the aspects of parliamentary control and political responsibility in which the Government is pressured when granting pardonsto those susceptible to judicial control in the face of eventual remedies. The report unfavourable to the granting of pardons by the Second Chamber of the Supreme Court and the SupremeProsecutor’s Office is analysed in detail and concludes that the pardons fulfil the requirementsof legality.
