El indulto es un auténtico –aunque muy frecuente— cuerpo extraño en un sistema democrático.Es una especie de válvula de seguridad que se activa cuando lo declarado por la Justicia puedeprovocar males mayores que los beneficios que la jurisdicción está llamada a producir. Con todo,¿quién debe hacer esa ponderación? En el presente trabajo se examinan diversas razones quedescartan que los tribunales puedan ser los depositarios de tal labor. Dado que también losgobiernos son inhábiles, finalmente se valora la alternativa de que sean los parlamentos comorepresentantes de la voluntad popular los que ejerzan esa función.
The pardon is an authentic —albeit very frequent— foreign body in a democratic system. It is akind of safety valve that is activated when what is declared by Justice may cause greater harmthan the benefits that the jurisdiction is called upon to produce. However, who is called uponto do this weighing up? This paper examines various reasons why the courts cannot be the repository of such a task. Since governments are also incapable of doing so, the alternative ofparliaments, as representatives of the will of the people, being the ones to carry out this task isfinally put forward.
