O final do século XX foi marcado por diversos fatores institucionais e políticos nassociedades latino-americanas. A esse contexto não interventivo materializado pelo Estado,acrescido ao reconhecimento de uma sociedade de base plural, ensejaram por uma novaordem constitucional. O estudo propõe-se a refletir como as constituições adotadas nesseperíodo histórico enfrentaram tanto os aspectos normativos conflitivos quanto apontarampara novos paradigmas institucionais. Soma-se que a esse universo analítico, há uma longatradição do pensamento social latino-americano crítico e alternativo. O estudo culmina com oindicativo de uma “epistemologia do sul” de base não eurocêntrica. A investigação objetivaresponder se os novos sistemas constitucionais são aptos a atender a essas formulaçõescríticas e autônomas. Independentemente das respostas encontradas, não deve ser esquecidoo exame de experiências inovadoras como determinadas jurisdições constitucionais na América Latina. A pesquisa empreendida cria condições para avaliar se o momentoconstitucional presente é uma ruptura ou uma continuidade no constitucionalismo latinoamericano.
The late twentieth century was marked by several institutional andpolitical factors in Latin American societies. In this context not interventionistmaterialized by the State, plus the recognition of a plural society base, gave rise to anew constitutional order. The study aims to reflect how the constitutions adopted inthis historical period faced both conflicting normative aspects as pointed to newinstitutional paradigms. In addition, this analytical universe has a long tradition ofsocial thought in Latin American critical and alternative. The study culminates with theindication of an "epistemology of the South" diverging from the Eurocentricperspective. The research aims to answer whether the new constitutional systems areable to meet these critical and autonomous formulations. Apart the solutions, shouldnot be forgotten the analysis of innovative experiences as certain constitutionaljurisdictions in Latin America. The research undertaken creates conditions to assesswhether the current constitutional period is indeed a rupture or a continuity in theLatin American constitutionalism.
