La gestión de la crisis de los refugiados: la especial vulnerabilidad de los menores

    En el presente documento se realiza un estudio jurídico actual acerca de la situación mundial de los refugiados. Para ello, se analiza la Convención de Ginebra sobre el Estatuto de los Refugiados al ser su principal instrumento de protección en el ámbito internacional. A nivel europeo, el número de refugiados ha aumentado exponencialmente desde 2015 por lo que también se examinará la regulación del sistema europeo común de asilo para conocer la tutela ofrecida a estos sujetos. Dentro de los refugiados un colectivo especialmente vulnerable son los menores no acompañados debido a lo cual se hará una revisión más pormenorizada. Se abordará tanto desde el contexto internacional como en el ámbito de la Unión Europea la protección concreta que se les brinda. Para concluir se revisará la sentencia del Tribunal de Justicia de la Unión Europea de 12 de noviembre de 2019, asunto C- 233/18 para determinar si se cumple la regulación comunitaria en el caso de un menor no acompañado y, en concreto, si se tiene en cuenta el interés superior del niño.

    This document carries out a current legal study on the global refugee situation. To this end, the Geneva Convention on the Status of Refugees is analyzed as it is its main instrument of protection in the international arena. At the European level, the number of refugees has increased exponentially since 2015, so the regulation of the common European asylum system will also be examined to find out the protection offered to these subjects. Within the refugees, a particularly vulnerable group is unaccompanied minors, for which a more detailed review will be carried out. The specific protection provided to them will be addressed both from the international context and within the scope of the European Union. To conclude, the judgment of the Court of Justice of the European Union of November 12, 2019, case C-233/18, will be reviewed to determine if the community regulation is complied with in the case of an unaccompanied minor and, specifically, if takes into account the best interests of the child.
