Este estudio analiza, respecto de los delitos contra la salud pública, el proceso de análisis de las sustancias aprehendidas, así como su pesaje, custodia y destrucción. Una vez realizada la valoración por los organismos oficiales encargados de ello, teniendo en cuenta los resultados podemos tipificar el delito y a su vez valorar la posible concurrencia de circunstancias modificativas de la responsabilidad. En concreto, analizamos el principio de insignificancia y la agravante de notoria importancia en la jurisprudencia del Tribunal Supremo.
This study analyses, with regard to crimes against public health, the process of analysis of the seized substances, as well as their weighing, custody and destruction. Once the assessment has been carried out by the official bodies in charge of this, taking into account the results, we can classify the crime and, in turn, assess the possible concurrence of circumstances modifying liability. Specifically, we analyse the principle of insignificance and the aggravating circumstance of notorious importance in the case law of the Supreme Court.
