    Conocer el trasfondo político es necesario para enmarcar la demanda de Georgia contra la Federación de Rusia y la sentencia del TEDH de 21 de enero de 2021. Sin embargo, el TEDH se ha inhibido de juzgar las eventuales violaciones del Convenio producidas durante el período del conflicto armado entre Rusia y Georgia y ha centrado su resolución en los actos ilegales cometidos tras la firma del alto el fuego por las tropas rusas y las milicias de Osetia del Sur y de Abjazia, y las tropas georgianas. Actos ilegales que ha condenado sin paliativos.

    Some knowledge of the political background is necessary to frame Georgia’s claim against the Russian Federation, and the ECHR ruling, of 21 January 2021. The ECHR refrained from judging the violations of the Convention that occurred during the period of the armed conflict between Russia and Georgia in 2008, and focused its judgment on the ilegal acts committed after the signing of the ceasefire by Russian troops and militias from South Ossetia and Abkhazia and the Georgian troops. Ilegal acts which it has condemned without appliative.
