La sentencia del Tribunal Supremo comentada incide en una de las cuestiones más controvertidas en materia de variedades vegetales, como es la referencia al alcance de la protección del obtentor. En esta sentencia el Tribunal Supremo sigue la interpretación dada por el Tribunal de Justicia de la Unión Europea con respecto a la articulación de la protección prevista en el artículo 13, apartado 2, letra a), y apartado 3, del Reglamento (CE) n.º 2100/94 del Consejo, de 27 de julio de 1994, relativo a la protección comunitaria de las obtenciones vegetales.
The Supreme Court Judgement discussed affects in one of the most controversial issues regarding plant variety subject, such as the reference to the scope of the protection of the breeder. In this judgement, the Spanish Supreme Court follows the interpretation given by the European Court of Justice on the articulation of the protection provided in Article 13, paragraph 2, letter a), and paragraph 3, of Council Regulation (EC) Nº 2100/94 of 27 July 1994 on Community plant variety rights.
