Se trata de reflexionar sobre la contradicción entre la discapacidad como problema real y el intento, reiterado en los últimos tiempos, de afirmar que, quienes la tienen y aun teniéndola, tienen plena capacidad, no solo jurídica, sino de obrar, en contra de la realidad más patente, inventándose, a tal efecto, la expresión “ejercicio de la capacidad jurídica”, fuente potencial o real de consecuencias indeseables.
The aim of this work is to think on the contradiction between disability, as a real problem, and the attempt, usual in recent times, to affirm that those who suffer inability and in spite of this, have full capacity, not only legal, but also to act legally, what is contrary to the most obvious reality, inventing, for this purpose, the expression «exercise of legal capacity», which results in a potential or real source of undesirable consequences.
