This paper argues that exemplary judges, that is, paradigmatically good judges, are vitally important both to inculcating the judicial virtues and to developing a theory of judicial virtue. Critically, such exemplars are not only real but also fictional. Thus, literature is central to both improving the judicial practice and theorizing about excellence in judging. Before and after the text of its author, which was translated from Spanish into Portuguese, the translator elaborated commentaries which intend highlight the importance of this work within the current researches on judicial ethics – Comentário inicial do tradutor – and discuss some aspects contended in the paper – Comentário final do tradutor.
Este artigo sustenta que os juízes exemplares, isto é, os juízes paradigmaticamente bons, são de vital importância tanto para promover as virtudes judiciais como para desenvolver uma teoria da virtude judicial. Modelarmente, esses exemplares não são apenas reais, mas também ficcionais. Assim, a literatura é central tanto para melhorar a prática judicial como para teorizar acerca da excelência no julgar. Antes e depois do texto da autora, que foi traduzido do espanhol, o tradutor elaborou comentários que pretendem salientar a importância deste trabalho dentro das pesquisas atuais sobre a ética judicial – Comentário inicial do tradutor – e discutir alguns aspectos sustentados no artigo – Comentário final final do tradutor.
