La participación como miembro de un órgano o tribunal de selección de personal, ya sea en calidad de Presidente, Secretario o Vocal, supone una importante responsabilidad dada la trascendencia y repercusión social que suelen tener los procesos selectivos en los que, además, entran en juego derechos y expectativas legítimas de muchos ciudadanos que concurren a las convocatorias de oposiciones, concursos o concursos-oposición, en la confianza de que la actuación que desarrolle el órgano de selección (por ejemplo, un Tribunal Calificador) se ajustará, estrictamente, a los principios constitucionales de igualdad, mérito y capacidad en el acceso a la función pública.
Los mencionados principios generales, piedra angular sobre la que gravita la normativa aplicable en la materia, no deben resultar considerados meras declaraciones de rango retórico o simples palabras grandilocuentes. Antes al contrario, son conceptos con un significado jurídico, al tiempo que contienen indudable carga ética, habiendo sido definidos y precisados, en toda su extensión, por la jurisprudencia de los Tribunales de Justicia y, de forma especial, por el Tribunal Constitucional.
Participation as a member of a personnel selection body, either as President, Secretary or Member, implies an important responsibility, according to the social relevance and repercussion that selective processes usually have themselves and additionally, their implications related to the rights and legitimate expectations of many citizens attending official competitions and contests, in the confidence that the action developed by the selection body (for example, a Selection Board) will scrupulously comply with the constitutional principles of equality, merit and ability to access the public service.
The aforementioned general principles, as a cornerstone that supports applicable regulations on the matter, should not be considered mere declarations of rhetorical level or just grandiloquent words. Instead, they are concepts with a legal meaning, while at the same time they are undoubted ethically charged, defined and specified, in their entirety, by the jurisprudence of the Courts of Justice and, in particular, by the Constitutional Court.
