El artículo analiza en primer lugar el histórico cambio normativo que han experimentado las fundaciones en España desde la aprobación de la Constitución de 1978, a pesar de que hasta la entrada en vigor de la Ley 30/1994 —posteriormente renovada por la Ley 50/2002— no existió una regulación normativa sistematizada sobre la materia. El trabajo aborda asimismo la cuestión de la posible realización de actividades económicas por las fundaciones y la disyuntiva entre la permisividad de tales actividades y la consecución de sus fines sociales. Finalmente, tomando como referencia la excepcional situación sanitaria generada por la COVID-19, se lleva a cabo una valoración de las singulares modificaciones de nuestra vigente Ley de Fundaciones y su adapta-ción al contexto social, económico y sanitario.
This article explains the historical regulatory change that the institution of foundations has undergone through in Spain, which was achieved with the Constitution 1998. However, a systematized regulatory regulation was not obtained until the entry into force of Law 30/1994, modified later with the Law 50/2002, both of them on Foundations. In addition, the article also presents the possible performan-ce of economic activities by foundations. This implies a dilemma between their permissiveness and the achievement of their social aims. Finally, due to the exceptional health crisis of Covid-19, an as-sessment is made about the singular modifications of the current Law on Foundations adapted to the social, economic and health panorama
