El presente artículo trata de investigar cuál es el impacto que tienen las acciones de la UNESCO sobre la definición de reclamaciones interpuestas para el ejercicio de los poderes soberanos sobre los lugares sagrados en disputa, su conservación y gestión. Los casos de Jerusalén, Cisjordania y el Templo de Preah Vihear son utilizados como herramientas que sirven para medir el impacto de la intervención de la UNESCO en áreas de soberanía disputadas, planteando así el problema principal del uso del patrimonio cultural religioso por parte de instituciones tanto nacionales como internacionales. En particular, a pesar del papel clave de la Asamblea General de la ONU y del Consejo de Seguridad de la ONU, el patrimonio religioso controvertido, después de la inclusión de la UNESCO en la Lista del Patrimonio Mundial, tiene un papel vehicular para el reconocimiento y la fundación del Estado palestino.
The current paper wants to investigate the impact of UNESCO’s actions for the definition of the claims for the exercise of sovereign powers over contested holy sites, their maintenance and management. The cases of Jerusalem, the West Bank and the Temple of Preah Vihear are examined as tools to test the impact of UNESCO’s involvement in areas of contested sovereignty, thus raising the major issue of the use of religious cultural heritage by both national and international institutions. In particular, notwithstanding the key role of the UN General Assembly and the Security Council, religious contested heritage, after its inclusion within UNESCO’s World Heritage List, has a vehicular role for the recognition and the foundation of the Palestinian State.
