¿En que consiste realmente la organización federalista del Estado moderno? ¿Este modelo es compatible con el tradicional Estado unitario del Ecuador y con su carácter plurinacional? Estas preguntas inquietan a más de uno y provocan o bien ferviente entusiasmo, o total repulsa en dependencia del punto de vista y preferencias de quien opina sobre el polémico tema. Sin embargo, es necesario realizar un análisis doctrinario y un recuento histórico para enfrentar de una ma-nera crítica y argumentativa la perspectiva de introducir esta forma de organiza-ción en el ordenamiento constitucional. Diferenciemos primeramente entre el fe-deralismo consistente en una unión estatal voluntaria y la organización derivada de un ordenamiento federativo. En este punto crucial radica el nudo gordiano que nos permitirá desentrañar la problemática. Abordemos a partir de allí la expre-sión soberana de voluntad por el pueblo constituyente, el precautelamiento de los derechos fundamentales, la conformidad con el régimen del Buen Vivir, las ga-rantías para esos derechos y el procedimiento de enmienda para variar la organi-zación territorial. El debate está abierto.

From there it ́s comes the expression Soberanity of will from the constituent town, the precaution of fundamentals rights accordance with the good living, the guarantees for these rights and the procedure of amendment vary the territorial organization.The debate it ́s open.
