El Derecho Pesquero supone una excepción relevante ante el régimen general de protección de la biodiversidad proclamado por el Derecho Ambiental, de manera que no le es de aplicación el sistema principal de protección a aquellas especies marinas objeto de la regulación de las pesquerías en el mar. Sin embargo, en aquellas especies cuyo ciclo vital transcurre en aguas continentales y el mar sí que es posible aplicar el Derecho de la Biodiversidad cuando las capturas se realizan en aguas continentales y se trata de una especie en situación crítica que merece una protección legal estricta e inmediata: la anguila europea o común.
Fisheries Law poses an exception to the general system of biodiversity protection under Environmental Law, so that species protection rules do not apply to those marine species commercially fished at the sea. However, it is possible to follow the species protection regime of Biodiversity Law in relation to those species whose life cycle straddles freshwaters and the sea and are captured inland, mainly in case of a critically endangered species that deserves an immediately strict protection: the European or common eel.
