Este trabajo tiene por objeto analizar las principales líneas de evolución del régimen de la responsabilidad medioambiental instaurado por la Ley 26/2007, de 23 de octubre. Se parte del estudio de sus principales características originarias para reflejar los cambios normativos que se han producido a lo largo de estos años y las consecuencias que han traído consigo en el presente. Finalmente, se identifican las cuestiones que están pendientes de resolver para garantizar la eficacia plena del régimen y se plantean propuesta sobre cómo abordarlas.
This paper tackles the main evolution lines of the environmental responsibility regime established by the Law 26/2007, of 23 October. It is based on the study of its main original characteristics to reflect the normative changes that have taken place during these years and the consequences that they have brought about in the present. Finally, this work identifies the pending issues to ensure the full effectiveness of the regime and proposes how to address them.
