El régimen jurídico aplicable al tema del otorgamiento de subsidios y contribuciones a sectores con menor capacidad adquisitiva de la población, ha sido objeto de múltiples interpretaciones y cambios en su marco normativo, a raíz de una serie de desarrollos reglamentarios proferidos por el Gobierno Nacional y de algunos fallos jurisdiccionales que han dejado sin piso algunas iniciativas gubernamentales en la materia. Así las cosas, el presente trabajo pretende determinar cuáles son los principales problemas que surgen en esa materia, especialmente en las entidades territoriales, a raíz de las múltiples transformaciones que recientemente ha sufrido el marco regulatorio aplicable a esta temática.
The legal regime applicable to the topic in relation with the grant of subsidies and contributions to sectors with minor acquisitive capacity of the population, has been the object of multiple interpretations and changes in its regulations framework, because of a series of development regulations issued by the National Government and some jurisdictional dispositions that oppose some governmental initiatives in the matter. Being this the state of the art, this work tries to determine which the principal problems that arise can be regarding this matter, especially in territorial entities because of the multiple transformations the regulatory framework has undergone recently.
