El siguiente escrito tiene por objeto analizar los diferentes escenarios regulatorios de la neutralidad de la red desde el punto de vista de Estados Unidos. En particular, estudia los argumentos declarados por las dos partes del actual debate sobre la neutralidad de la red a fin de determinar qué postura regulatoria ha de adoptarse. Para tal propósito, este estudio describirá la naturaleza del Internet y algunas de sus múltiples facetas tecnológicas. Adicionalmente, busca presentar el contexto jurisprudencial y de políticas regulatorias relacionado con el hecho de que la regulación estaría estrechamente ligada con disposiciones constitucionales y de mercado.
The following paper has the aim of analyzing the different regulatory scenarios of the network neutrality from the United States’ point of view. In particular, it studies the current arguments asserted by both sides in connection with network neutrality debate in order to determine which regulatory position should be adopted. For such purpose, the present study will portray the nature of the Internet and some of its multiple technological facets. It also attempts to present the case-law and regulatory policy context related to the fact that regulation over the Internet it would be closely linked to constitutional and market provisions.
