This article is an application of the methodology Law in Literature, with bibliographic research. It develops the concept of education in Human Rights, based on the dignity of the human person, the right to non-discrimination, and the general principle of equality in law, all ideas acknowledged by the Brazilian Federal Constitution of 1988 and the current norms in the context of family and domestic violence in Brazil. It presents an interdisciplinary dialogue between the legal doctrine and the novel Purple Hibiscus, in attempt to map the main actions applied in Brazil by the Interamerican Human Rights System in the Maria da Penha case. Thus, it is possible to establish an exchange between human and fundamental rights, through inclusion policies, information sharing and empowerment, especially regarding women and children.
Artigo que, por meio do emprego da metodologia Direito na literatura e da pesquisa bibliográfica, tematiza a articulação da educação em Direitos Humanos com base na dignidade da pessoa humana, no direito à antidiscriminação e no princípio e direito geral de igualdade, reconhecidos pela Constituição Federal de 1988 e nas normas que ora perfazem o bloco de constitucionalidade com o atual contexto brasileiro marcado pela violência doméstica e familiar. A partir do diálogo interdisciplinar com a dogmática jurídica e a partir de uma leitura crítica da obra literária Hibisco roxo, intenta-se mapear as principais ações encetadas a partir da condenação do Brasil pelo Sistema Interamericano de Direitos Humanos no caso Maria da Penha, de forma a assegurar e a promover o catálogo de direitos humanos e fundamentais, mediante políticas de inclusão, de informação e de empoderamento, sobretudo voltadas para as mulheres e as crianças.
