El contenido colectivo de la libertad sindical se contempla en España en la Constitución de 1978 de forma limitada, ya que el art. 28.1 de esta norma hace referencia únicamente al derecho de federación nacional e internacional: “(…)el derecho de los sindicatos a formar confederaciones y a fundar organizaciones sindicales internacionales o afiliarse a las mismas.”Es, por tanto, la Ley Orgánica de Libertad Sindical y el Tribunal Constitucional en sus diversos pronunciamientos los que han completado los derechos que corresponden a las organizaciones sindicales en el ejercicio de la libertad sindical
The collective content of syndicate freedom in Spain is ruled by the Constitution in a limited way, as art. 28.1 refers only to national and international federation rights: “(...) the right of unions to form confederations and to found international union organizations or to join them”. It is, therefore, the Organic Law of Freedom of Association and the Constitutional Court in its various pronouncements that have defined the rights that correspond to trade union organizations in the exercise of freedom of association.
