En la Comisión Tercera del Senado se discutirá en los próximos meses el Proyecto de Ley 038 de 2015, “por el cual se introducen modificaciones al régimen de protección de la competencia, a las funciones de la Superintendencia de Industria y Comercio y se dictan otras disposiciones”. El presente artículo pretende, tras describir la manera como está estructurado actualmente el derecho de la competencia en Colombia, discutir los cambios que esta iniciativa pretende introducir y los temas que no fueron incluidos
Bill 038, 2015, whose purpose is to introduce several modifications to the Colombian competition regime and the functions that the Superintendence of Industry and Commerce has, will be discussed in the forthcoming months in the Third Committee of the Senate. This paper aims to show the manner in which competition law is structured nowadays in Colombia to subsequently discuss the aspects that the said bill intends to introduce in this regime and the needed changes that it ignored.
