El Tribunal de Justicia de la Unión Europea estima que el juez del Estado miembro competente para conocer el procedimiento de insolvencia tiene jurisdicción exclusiva para conocer, ex art. 3.1 del Reglamento (CE) 1346/2000, de las acciones relativas a la nulidad de los actos perjudiciales para el conjunto de los acreedores. Ello se deriva de que se trata de litigios que se derivan directamente del procedimiento de insolvencia y guardan una estrecha relación con éste, de modo que su concentración frente al juez del concurso mejora la eficacia y rapidez en su tramitación. Frente a ello no puede oponerse que tales controversias se refieran a bienes inmuebles sitos en el territorio de otro Estado miembro.
The Court of Justice of the European Union considers that the court of a Member State which is competent over the main insolvency proceeding has also exclusive jurisdiction to rule, ex article 3.1 of the Regulation (EC) 1346/2000, the actions relating to the voidness of legal acts detrimental to all the creditors. This stems from the fact that these are litigations that derive directly from those proceedings and which are closely connected with them. In this way, concentrating such actions before the court that rules the bankruptcy is consistent with the objective of improving the efficiency and speed of insolvency proceedings having cross-border effects. That reasoning cannot be called into question by the fact that the action concerns immovable property which is located within the territory of other Member State
