El objetivo de esta contribución es arrojar algo de luz sobre la implementación del pluralismo legal y las políticas constitucionales interculturales en el Sur Global, comparando las experiencias del país andino de Bolivia con la historia institucional de la Unión Indiana. La comparación entre estas experiencias aún no se ha explorado, a pesar de sus puntos en común: un patrimonio indígena contrahegemónico y un tejido social genéticamente intercultural. Si bien la India supuestamente representa el prototipo del "Estado multicultural", en los últimos años la atención de los estudios jurídicos comparados se ha centrado cada vez más en la región latinoamericana, como un laboratorio vivo para la "Ingeniería constitucional intercultural". Aunque el papel de las recientes Constituciones de Ecuador y de Bolivia (CPE, 2008; CPB, 2009) es posiblemente el de las constituciones más progresistas jamás escritas, reconociendo expresamente la plurinacionalidad, los derechos colectivos, la personalidad jurídica de la Madre Tierra y los diversos grados de autonomía administrativa para las comunidades indígenas. - el discurso eufórico que han adoptado algunos observadores debe atenuarse analizando las contradicciones que han afectado la implementación de estos textos a nivel político. La crisis boliviana más reciente ha mostrado cómo estos elementos contradictorios han afectado a los mecanismos de la democracia participativa, profundizando en la articulación plurinacional del Estado diseñado a nivel discursivo en los textos constitucionales. Estas paradojas merecen ser exploradas con más desapego para evitar la posibilidad de un error como el de Colón: es decir, en la búsqueda de un modelo de Estado multicultural, buscar el prototipo indio en un ambiente latinoamericano extremadamente divergente.
The aim of this contribution is to shed some light on the implementation of legal pluralism and intercultural constitutional policies in the Global South, comparing the experiences of the Andean country of Bolivia to the institutional history of the Indian Union. The comparison between these experiences has yet to be explored, despite their commonalities: an indigenous, counter-hegemonic heritage and a genetically intercultural social fabric. While India allegedly represents the prototype of the “Multicultural State”, in recent years the attention of comparative legal scholarship has been increasingly drawn to the Latin American region, as a living laboratory for “Intercultural Constitutional Engineering”. Even though on paper the recent Constitutions of Ecuador and Bolivia (CPE, 2008; CPB, 2009) are arguably the most progressive constitutions ever written – expressly recognizing plurinationality, collective rights, legal personality of Mother Earth and varying degrees of administrative autonomy for indigenous communities – the euphoric discourse that some observers have adopted must be tempered by analyzing the contradictions that have afflicted the implementation of these texts on a political level. The most recent Bolivian crisis has shown how these contradictory elements have affected the mechanisms of participative democracy, undermining the plurinational articulation of the State engineered at a discursive level in the constitutional texts. These paradoxes deserve to be explored with more detachment to avert the possibility of a Columbus’ mistake: that is, in the search for a multicultural State model, to look for the Indian prototype in the extremely divergent Latin American environment.
