El principal objetivo de este artículo es analizar y mostrar las reactualizaciones del debate en torno al comienzo de la existencia de la persona humana en el contexto de un proceso puntual, que culminó con la sanción del actual artículo 19 del Código Civil y Comercial de la Nación. Para esto hemos definido como nuestra unidad de análisis los debates parlamentarios del anteproyecto,centrándonos en el análisis de argumentos expresados por los legisladores en las sesiones de la Cámara de Diputados y Senadores en 2014 en las cuales fue aprobado el Código Civil y comercial de la Nación.Nuestra hipótesis central es que en estos debates en torno al uso de algunos términos, con sus explicitaciones y silencios, se pone en juego, una vez más, la posibilidad de delimitar el cuerpo de las mujeres (y de otros sujetos con capacidad para gestar) en Argentina. Estos cuerpos se configuran entonces como un territorio, mapeable, cuyas fronteras son objeto de luchas. Realizamos un análisis documental adaptando las estrategias cualitativas de la Teoría fundamentada,y analizando los resultados desde una perspectiva crítica sociológica y filosófica en el contexto del análisis del discurso jurídico
The main objective in this article is to analyze and show the transformations of the debate around the beginning of the existence ofhuman being in the context of a punctual process, which led to the current drafting of the 19th article of the Civic and Commercial Code. To do so we have defined the parliamentary debates as our analysis unit focusing in the arguments expressed by the legislators in the "Diputados" and "Senadores" chambers in 2014, in which the Civic and Commercial code was approved. Our main hypothesis is that in this debates around the uses of some terms, the possibility of determinatethe limits of women ́s bodies (and also from other gender groups) is at stakein Argentina. This bodies are configured as territories and their borders are objects of struggle. This led to this proposal to carry out of a documental analysis adapting the qualitative strategies of the Grounded Theory and analyzing its results from a critical sociological and philosophical perspective of the legal discourse.
