La responsabilidad presidencial en México es un debate actual. En los siglos XIX y XX, el presidente de la República ha asumido la concentración del poder sin contrapesos. En realidad, la responsabilidad del primer mandatario de la nación ha sido una norma ambigua, compleja y de imposible aplicación constitucional: a partir de su inmunidad, el presidente es impune de sus actos. Desde la etapa del México independiente (1810) hasta la era revolucionaria (1910) y constitucional (1917), el poder presidencial no ha asumido responsabilidad por sus actos arbitrarios. En la situación actual del Gobierno presidencial (2018-2024), sin embargo, se plantea la idea de establecer dos figuras constitucionales para que el presidente rinda cuentas ante el pueblo: por un lado, la revocación de su mandato por medio de una consulta popular; por otro, permitir su enjuiciamiento por cualquier delito sin necesidad de un control parlamentario hasta que exista una sentencia condenatoria. En el presente trabajo se describe los retos y desafíos a discutir de estas reformas constitucionales.
There is a current debate in Mexico regarding the presidential liability. In the XIX and XX centuries, the president of the Republic has concentrated the power without any counterpart. In fact, the responsibility of the chief executive has been an ambiguous, complex and impossible to comply constitutionally: from their immunity, the president is unpunished. Since the independence of Mexico (1810) to the revolutionary era (1910) and constitutional one (1917), the presidential power has not assumed any responsibility for their arbitrary acts. In the current presidential government (2018-2024), however, some ideas have arisen to establish two constitutional figures to ensure the presidential accountability: on the one hand, the withdrawal of their mandate through a popular consultation; on the other hand, to enable their prosecution for any crime without requiring any parliamentary control until the issue of a condemnatory sentence. In this article, challenges are described in order to discuss the aforementioned constitutional reforms.
