Este artículo examina el Global Compact Migration (GCM) desde la perspectiva de las convenciones de derechos humanos de la ONU. Como se indicó anteriormente, la migración ha sido un campo disputado en la política internacional.
Incluso la aplicación de los derechos humanos internacionales contenidos en las convenciones de la ONU a los migrantes ha sido cuestionada (particularmente en lo que respecta a la prestación en la práctica). Si bien hay muchas referencias a los instrumentos de derechos humanos y de derechos humanos en los dos documentos, con algo de inflación de la Declaración al GCM, aún será necesario prestar mucha atención a su implementación en la práctica. Esto se debe a que las referencias a los derechos humanos no están totalmente ancladas en las convenciones de derechos humanos de la ONU y no son lo suficientemente precisas. Esto hará que la implementación sea mucho más difícil de lo que hubiera sido si el GCM hubiera referenciado adecuadamente los compromisos de derechos humanos relevantes en cada objetivo y principio en lugar de simplemente referirse a los "derechos humanos" en general. El estado actual del derecho internacional de los derechos humanos y su aplicación a los migrantes está menos desarrollado adecuadamente en ambos instrumentos. This article examines the Global Compact Migration (GCM) from the perspective of the UN human rights conventions. As indicated, migration has been a contested field in international politics. Even the application of international human rights as contained in the UN conventions to migrants has been doubted and questioned (particularly as regards delivery in practice). It will examine two main issues: Firts, the New York Declaration and human rights – what is the position of human rights in the Declaration; Second, the Global Compact Migration through the lens of the human rights commitments set out in the Declaration. I examined the Declaration and the GCM to identify the importance of human rights in the commitments and obligations set out in each of them and how they reflect (or not) one another. In my analysis of the GCM and the Declaration the position of human rights in the commitments and the objectives of the two tends to be symbolic and fails to be fully integrated into the content of each commitment or objective. While there are many references to human rights and human rights instruments in the two documents, with something of an inflation from the Declaration to the GCM, still great attention will need to be given to their implementation in practice. This is because the references to human rights are not fully anchored in the UN human rights conventions and insufficiently precise. This will make implementation much more difficult than it would have been had the GCM properly referenced the relevant human rights commitments in each objective and principle rather than simply referring to ‘human rights’ in general. The actual state of international human rights law and its application to migrants is less than adequately developed in both the instruments. Although the CGM is formally committed to non-regression as regards existing human rights obligations of states, there is much ambiguity in many of the objectives and the options for implementation.
Depending on the political preferences of some governments, numerous choices are open to implementation in a manner which could result in regression from existing human rights standards. This must be avoided at all costs
