En el sistema jurídico colombiano, el arbitraje tiene naturaleza jurisdiccional. En consecuencia, los árbitros gozan de las potestades declarativas que tienen los jueces de lo contencioso administrativo cuando juzgan a la Administración Pública. Si ello es así, y si tienen la competencia para declarar la nulidad de actos administrativos, con excepción de los que se dictan en ejercicio de facultades excepcionales, tienen también la competencia para hacer uso de la excepción de ilegalidad.
In the Colombian legal system, arbitration has a jurisdictional nature. Consequently, the arbitrators enjoy the declarative powers that the administrative litigation judges have when they judge the Public Administration. If this is the case, and if they have the competence to declare the nullity of administrative acts, with the exception of those that are issued in the exercise of exceptional powers, they also have the competence to make use of the exception of illegality.
