The Inter-American Court of Human Rights turned 40: achievements and challenges

    La Corte Interamericana de Derechos Humanos cumplió 40 años en 2018, y en 2019 cinco gobiernos pertenecientes a la OEA firmaron una declaración exigiendo cambios en su actitud hacia los Estados sujetos a su jurisdicción. Este texto analiza la evolución de la Corte teniendo en cuenta su fundamento jurídico, su contexto y la evolución de su jurisprudencia hasta los casos recientes relacionados con los derechos económicos y sociales. Ofrece una evaluación crítica de la situación actual y concluye con una serie de reflexiones y propuestas sobre cómo aumentar la legitimidad de la Corte.

    The IACtHR turned 40 in 2018, and in 2019 five governments belonging to the OAS signed a declaration demanding changes in its attitude towards the states subject to its jurisdiction. This text analyzes the evolution of the IACtHR taking into account its legal basis, the context and the evolution of its jurisprudence until recent cases addressing economic and social rights. It offers a critical assessment of the current state of affairs concluding with a series of reflections and proposals on how to increase the Court’s legitimacy.
