En este artículo se van a examinar algunas particularidades relativas a la fórmula procesal que se encuentra en el texto conservado de la lex rivi Hiberiensis, documento epigráfico de la provincia Tarraconense fechado en época adrianea, que contiene, según los especialistas, el estatuto jurídico de una comunidad de regantes. Se considerará el fundamento jurídico de la acción que allí aparece y los problemas surgidos en cuanto a su interpretación, así como las soluciones propuestas por los especialistas en la materia que se esfuerzan en colocar la fórmula examinada en una precisa categoría -ius civile, ius honorarium- y de darle un sentido desde el punto de vista del derecho romano; ello aporta datos relevantes sobre el estudio del procedimiento formulario en las provincias del imperio romano.
In this article we want to examine some particularities related to the procedural formula found in the preserved text of the lex rivi Hiberiensis, an epigraphic document of the Tarraconensis province dating from the Adriaan period, which contains, according to the specialists, the regulation of a community of irrigators. It is a question of considering the legal basis of the action that appears in it, the problems arising in terms of its interpretation as well as the proposed solutions. The specialists in the matter strive to place the formula examined in a precise category -ius civile, ius honorarium- and to give sense of it from the principles of the Roman law. Undoubtedly, it provides relevant data on the study of the form procedure in the provinces of the Roman Empire.
