    El artículo, sobre la base del corpus iuris que tiene como raíz el artículo 19 de la Convención Americana sobre Derechos Humanos y la Convención sobre Derechos del Niño, sistematiza los estándares jurisprudenciales de la Corte IDH sobre la materia, planteando el aseguramiento y garantía constitucional de los derechos del niño y adolescentes, teniendo como antecedentes diversas Constituciones latinoamericanas o reformas constitucionales que aseguran los derechos del niño en las últimas décadas en América Latina.
