La hoy llamada cuarta vidual, como corroboran las novelas justinianeas, es una institución vinculada en sus orígenes tanto al Derecho de familia, en concreto, a la que ha sido denominada cuarta marital en su acepción penal, pues en ésta encuentra una parte importante de sus raíces, como al Derecho sucesorio. Se trata, en síntesis, de una figura encaminada a solventar, en el caso de nupcias sine dote y donación nupcial, la situación de pobreza sobrevenida al cónyuge viudo y al final de la evolución justinianea, a la viuda, precisamente, por la ausencia de instrumentos dotales en su matrimonio.
The nowadays known as “cuarta vidual” or widow´s allowance, as stated by the Justinian novellas, is an institution linked in its origins both to family law and in particular to the marital fourth in criminal law, thus are an important basis of the law of successions. In summary, this is a figure designed to solve the supervening poverty of the widowed spouse in the case of nuptials sine dote and nuptial donation, and at the end of Justinian's evolution, to resolve the absence of the widow’s dowry instruments in the marriage.
